Terms of Use

These Terms of Use (the Terms) govern access to and use of RexiMemo, including the RexiMemo website, the Flipnote Studio/DSi service, its DNS, NAS and authentication services, community features, moderation systems, and any related software or server features made available by the operator of this RexiMemo deployment (together, the Service). By creating an account, signing in, linking a console, uploading or interacting with content, or otherwise using the Service, you agree to these Terms.

1. Who operates the Service

For a hosted RexiMemo deployment, the person or organisation running that deployment is the Operator. References to “RexiMemo”, “we”, “us” and “our” in these Terms mean the Operator when talking about operation of the Service. RexiMemo is based on and incorporates open-source software and other third-party components, but the authors or maintainers of those components are not automatically responsible for a particular RexiMemo deployment.

2. Eligibility and younger users

You may use RexiMemo only if you can lawfully agree to these Terms where you live. If you are not old enough to agree on your own, a parent or legal guardian must review and agree to these Terms for you and supervise your use. RexiMemo does not currently ask for a date of birth or operate an independent age-verification system. Do not submit personal information that you do not need to share, especially if you are a younger user.

3. Accounts and credentials

• You are responsible for the activity on your account and for keeping your password reasonably secure.
• Use a unique password that you do not reuse for important accounts. The DSi and some RexiMemo deployments use legacy network technology that does not provide the same transport security as a modern HTTPS-only service.
• Do not impersonate another person, falsely claim ownership of an FSID or Flipnote, obtain another user’s credentials, or bypass account restrictions.
• We may require a password change, revoke sessions, or require re-authentication when needed for security or administration.

4. Consoles, FSIDs and DSi identity

RexiMemo links DSi-family identities to accounts using Flipnote creator FSIDs. A DSi sign-in may require a small Flipnote upload so the Service can read the creator FSID before the account username and password are entered. An account may have multiple linked FSIDs, but one may be designated the Primary Console for uploads. The Service may also store a console name, selected device model, first/last-seen times and whether the connection appears to come from melonDS.

Your linked FSIDs and which FSID is Primary may be visible on your public Creator’s Room/profile on both web and DSi. Treat an FSID as a persistent public identifier.

5. Community features

RexiMemo may provide public profiles, Creator’s Rooms, Flipnote uploads and playback, comments (including memo/Flipnote comments), channels, stars, favorites, follows, notifications, view/download counts, search, rankings and other community features. Features may differ between web and DSi and may change over time.

6. Your content and your responsibility

User Content means anything you submit, upload, post, publish or otherwise provide through RexiMemo, including Flipnotes, PPM files, frames, audio, titles, creator/editor metadata, comments, memo comments, profile text, usernames, console names and other material.

• You keep whatever ownership rights you already have in your User Content.
• You must have the rights and permissions necessary to upload and share it.
• You are responsible for what you publish and for avoiding disclosure of private or sensitive information in public content.
• Uploading another person’s work does not make it yours. Original-creator information embedded in a Flipnote may be preserved and displayed.

7. Licence you grant to RexiMemo

By submitting User Content, you grant RexiMemo and the Operator a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, cache, copy, reproduce, encode, decode, convert, resize, make thumbnails or previews from, modify, adapt, edit, translate, transmit, publicly display, publicly perform, distribute, archive, preserve, moderate, test with, demonstrate, promote and otherwise use that User Content for any lawful purpose reasonably connected with RexiMemo, its community, operation, development, preservation, safety, documentation, promotion, research into the Service, or a successor or replacement for the Service.

This is intentionally a broad licence because RexiMemo needs to copy and transform Flipnotes across old DSi formats and modern web formats, maintain caches and archives, moderate content, develop features and keep community material available. It does not transfer ownership of your content to RexiMemo. We will not use your identity to imply that you endorse an unrelated third-party product or service without permission.

The licence continues for as long as the content is used by the Service and for a reasonable period afterward where copies remain in backups, caches, diagnostic material, moderation evidence, archives, reposts or other users’ legitimate copies. Where the law gives you a right to erasure or withdrawal that overrides this licence, those rights still apply.

8. Public content and redistribution

Content published to RexiMemo should be treated as public unless the interface clearly says otherwise. Other users may view, download, screenshot, save, quote, star, favorite or otherwise interact with public material. We cannot guarantee that copies made by other users disappear if the original is later removed.

9. Acceptable use

You must not use RexiMemo to:

• break applicable law or encourage serious unlawful conduct;
• upload material you do not have permission to use;
• harass, threaten, stalk, exploit or deliberately target another user;
• publish another person’s private information without appropriate permission;
• post sexual or exploitative material involving minors, non-consensual sexual material, or other content whose possession or distribution is unlawful;
• send spam, manipulate stars/follows/views, automate abusive traffic, or interfere with rankings or community features;
• upload malware or use RexiMemo to attack, scan, overload, bypass, reverse-engineer for abuse, or disrupt the Service or other systems;
• evade a suspension, moderation action, upload restriction or Primary Console restriction;
• abuse RexiMemo’s DNS/NAS/Auth services for unrelated traffic or intentionally route third-party systems through them.

10. Moderation and enforcement

RexiMemo may use automated filters and human moderation. A configurable swear filter may automatically reject comments, titles or published creator-name metadata that matches blocked terms. Automated filtering can make mistakes and is not guaranteed to catch every violation.

Administrators and moderators may review public and non-public account information reasonably necessary for moderation, including raw Flipnotes, individual frames, comments, linked FSIDs/consoles, session information, moderation history and relevant technical logs. Staff may hide or restore content, lock comments, suspend or restore accounts, revoke sessions, keep private notes, log incidents and record staff actions. Moderation records may be retained after content is removed when reasonably necessary for safety, abuse prevention, consistency, legal compliance or dispute handling.

We may take action with or without advance notice when reasonably necessary. Moderation decisions are not a promise that all objectionable content will be found or removed.

11. Legacy DSi networking

Using RexiMemo from Flipnote Studio can require the DSi to use the Operator’s DNS server so Nintendo/Hatena-era hostnames resolve to RexiMemo. The Service may implement Nintendo NAS/Auth compatibility and legacy SSLv3 session behaviour required by the unmodified DSi client. Much of the historical Flipnote Studio protocol uses plain HTTP after authentication. These protocols are obsolete and are not equivalent to modern end-to-end HTTPS security.

When using RexiMemo DNS, your console may send DNS queries that are unrelated to RexiMemo; non-local queries can be forwarded to an upstream resolver. The Operator may also enable diagnostic packet capture. Do not use the RexiMemo DSi network path to transmit unrelated sensitive information.

12. Open-source software and source availability

RexiMemo is based on, incorporates, or has been informed by open-source software and community research. Each third-party component remains subject to its own licence and copyright notices. These Terms do not override any open-source licence.

The fact that RexiMemo is based on open-source software does not mean that the complete current RexiMemo deployment, private modifications, server configuration, moderation tools, operational code or future source code must be publicly released except where an applicable software licence or law specifically requires it. User databases, credentials, moderation records and private operational data are not made open source merely because the software uses open-source components.

13. RexiMemo branding and third-party trademarks

RexiMemo’s own name, branding, site design and original material may be protected separately from the open-source components it uses. Flipnote Studio is a trademark of Nintendo. Flipnote Hatena is a trademark of Hatena Co., Ltd. RexiMemo is not affiliated with, sponsored by or endorsed by Nintendo or Hatena.

14. Copyright and other rights complaints

If you believe content on RexiMemo infringes your copyright, privacy or other legal rights, contact the Operator and identify the material, the right you believe is affected, and enough information to investigate. We may remove or restrict material while a complaint is reviewed. Do not knowingly submit false rights complaints.

15. Service changes, compatibility and availability

RexiMemo is a community/legacy-compatibility service. We may add, change, remove or discontinue features, protocols, channels, APIs, moderation tools or client support. We do not guarantee uninterrupted availability, permanent storage, compatibility with every DSi/3DS-family system, preservation of every upload, or that Nintendo/Hatena-era software will continue to function after network, operating-system or hardware changes.

You should keep your own copies of material that matters to you.

16. Suspension, termination and deletion

You may stop using RexiMemo at any time. The Operator may suspend or terminate access where reasonably necessary for these Terms, safety, security, abuse prevention, legal compliance or operation of the Service. Where account deletion is not available as a self-service option, you may ask the Operator to delete or anonymise account data where applicable. Some information may remain where reasonably necessary for backups, security, moderation evidence, legal obligations, public-content integrity or the rights of other users.

17. Privacy

The RexiMemo Privacy Policy explains how account, console, session, network, content and moderation data are handled. It forms part of these Terms.

18. Disclaimers

To the fullest extent permitted by applicable law, RexiMemo is provided “as is” and “as available”. We do not promise that the Service will be error-free, secure against every attack, uninterrupted, or suitable for a particular purpose. Legacy DSi protocols have known security limitations.

Nothing in these Terms excludes or limits rights or liabilities that cannot lawfully be excluded, including mandatory consumer rights where they apply.

19. Limitation of liability

To the fullest extent permitted by law, the Operator is not responsible for indirect or consequential loss, loss of data, loss caused by third-party copies of public User Content, or loss caused by service interruption, legacy protocol limitations or unsupported hardware/software. If the law gives you non-excludable remedies, those remedies remain available.

20. Changes to these Terms

We may update these Terms as RexiMemo changes. The current version will be published on this page with an updated effective date. Where a change materially affects users’ rights or use of their content, we will make reasonable efforts to call attention to it before or when it takes effect. Continued use after the effective date means you accept the updated Terms, except where applicable law requires another form of agreement.

21. General

If one part of these Terms is unenforceable, the rest remains in effect. A failure to enforce a provision once does not waive it. Mandatory laws and consumer protections in your country continue to apply. Unless mandatory law says otherwise, disputes are governed by the law applicable to the Operator where the Operator is established.
