Terms of Use

These Terms of Use (the Terms) govern your use of RexiMemo, including the RexiMemo website, Flipnote Studio/DSi service, community features and related services (together, the Service). By creating an account, signing in, linking a console, uploading or interacting with content, or otherwise using the Service, you agree to these Terms.

RexiMemo is currently an Open Beta. Features may be incomplete, change during testing, become temporarily unavailable or behave differently as the Service develops.

1. About RexiMemo

RexiMemo is a community-driven Flipnote Studio service available at reximemo.net. RexiMemo publishes a reduced public edition called RexiMemo Open Source Edition (OSE) under the GNU Affero General Public License version 3. The live production service is not fully open source: OSE is not a source dump of reximemo.net, and production-only security, privacy, identity, moderation, operations, migration, community and integration systems remain private. Third-party components remain subject to their own licences and terms.

2. Eligibility and age requirement

You must be at least 13 years old to use RexiMemo. Children under 13 may not create an account, sign in, link a console, upload content, interact with content or otherwise use the Service, even with permission or supervision from a parent or guardian.

You must also be legally able to agree to these Terms where you live. If applicable law requires parental or guardian consent for a user who is 13 or older, that consent is required. RexiMemo does not currently operate an independent identity or age-verification system. If we reasonably believe that an account is being used by someone under 13, we may suspend or terminate access and restrict or remove associated content.

Sensitive 16+ access

Sensitive 16+ is an age-restricted RexiMemo channel. You must be 16 or older to browse, watch, post to, or move a Flipnote into Sensitive 16+. Access is determined from the Date of Birth stored on your RexiMemo account. The Date of Birth you provide must be accurate; deliberately entering a false date to bypass an age restriction is prohibited.

Providing a Date of Birth does not mean RexiMemo has independently verified your identity or age. Sensitive 16+ eligibility is an access-control decision calculated from the date supplied to RexiMemo. The Date of Birth is handled as described in the Privacy Policy.

3. Accounts and credentials

• You are responsible for activity on your account and for keeping your password and any other account credentials secure.
• Use a password that you do not reuse for important accounts. The DSi side of RexiMemo relies on legacy networking that does not provide the same transport security as a modern HTTPS-only service.
• If you add a passkey, treat the device, authenticator or credential-provider account that can use or sync that passkey as part of your account security. Remove a passkey from RexiMemo if you no longer control or trust it.
• RexiMemo passkeys use WebAuthn public-key authentication. RexiMemo receives the public credential information and verification metadata needed to recognize the passkey; the private passkey key and any biometric, PIN or device-unlock secret used by your authenticator are not provided to RexiMemo.
• Do not impersonate another person, obtain another user’s credentials, falsely claim ownership of an FSID or Flipnote, or bypass account restrictions.
• We may require re-authentication, a password change, passkey removal or session revocation when reasonably necessary for security or administration.

4. API access and automated clients

RexiMemo may provide a personal application programming interface (the API) for software that interacts with the Service. API access is part of the Service and is subject to these Terms, the current API documentation, technical limits, and any feature-specific restrictions shown by RexiMemo.

• Your API key acts as your account. You are responsible for activity performed with a valid API key issued to your account until that key expires or is revoked. Keep API keys private, do not publish them in source code or shared client builds, and revoke a key promptly if you believe it has been exposed.
• You may use the API for personal, educational, community, open-source, and commercial projects, provided the project and its use of RexiMemo comply with these Terms. Commercial use does not create an endorsement, partnership, or right to use RexiMemo branding beyond what applicable law otherwise permits.
• You may charge for your own software or service, but you may not sell, rent, publish, harvest, or transfer users' RexiMemo API keys; resell raw RexiMemo API access; impersonate RexiMemo; or mislead users about who operates your project.
• Do not use the API to evade moderation, account restrictions, rate limits, upload restrictions, experiment access controls, or other technical safeguards. Do not use automation to spam, manipulate stars/follows/views, scrape non-public information, overload the Service, or interfere with normal use by other people.
• An API endpoint returning data does not give you ownership of that data or additional rights to another user's content. You remain responsible for copyright, privacy, data-protection, and other obligations that apply to your project.

RexiMemo may monitor and rate-limit API traffic, suspend or revoke API access for abuse, and require changes to clients that cause operational or security problems. The API is provided during the Open Beta without a compatibility guarantee: endpoints, fields, authentication rules, limits, and entire API versions may change, introduce breaking changes, be deprecated, or be discontinued. RexiMemo does not promise that a particular API version or integration will remain available for any minimum period.

5. Consoles, FSIDs and DSi identity

RexiMemo uses Flipnote creator FSIDs to associate compatible DSi-family identities with accounts. A sign-in or linking flow may require a small Flipnote so RexiMemo can verify the creator identity. An account may have multiple linked FSIDs, with one designated as the Primary Console for features that require it.

Linked FSIDs and Primary status may be displayed publicly in Creator’s Rooms on web and DSi. Treat an FSID as a persistent public identifier. Other console information may be stored or displayed where the relevant feature makes that clear.

6. Community features

RexiMemo may provide public profiles, Creator’s Rooms, Flipnote uploads and playback, comments, memo comments, channels, stars, favorites, follows, notifications, Flipnote collaborations, user blocking, view/download counts, search, rankings and other community features. Features can differ between web and DSi and can change during the Open Beta.

Flipnote collaborations

A Flipnote owner may invite another RexiMemo user to be credited as a collaborator. An invitation does not by itself transfer ownership of the Flipnote or give the invited user control over the owner’s account or content. If the invited user accepts, RexiMemo may publicly display both creators on that Flipnote and may apply the collaboration-credit rules shown by the Service. The owner may remove a collaborator and an accepted collaborator may leave where those controls are available.

Do not use collaboration invitations to impersonate another creator, falsely attribute work, spam or harass another user, or manipulate stars, rankings or other community statistics.

Blocking users

Blocking is an account-level boundary feature. While a block is active, RexiMemo may hide Flipnotes, comments, profiles or profile details between the two users; suppress interactions and notifications; remove follows or upload-notification subscriptions; and cancel pending collaboration invitations between those accounts. The exact presentation can differ between web and DSi.

Blocking does not delete the other person’s account or public content from RexiMemo generally, and it is not the same as reporting a user to moderators. Attempting to get around another user’s block in order to target, contact or harass them may itself violate these Terms.

7. Your content and your responsibility

User Content means anything you submit, upload, post or otherwise provide through RexiMemo, including Flipnotes, audio, titles, descriptions, creator/editor information, comments, memo comments, profile text, usernames, console names and channel content.

• You keep whatever ownership rights you already have in your User Content.
• You must have the rights and permissions needed to upload and share it.
• You are responsible for what you publish and for avoiding unnecessary disclosure of private or sensitive information.
• Uploading another person’s work does not make it yours. Original-creator information associated with a Flipnote may be preserved and displayed.

Encoded Flipnotes

Encoded Flipnotes are allowed on RexiMemo, but they are subject to stricter rules in addition to every other part of these Terms. For this subsection, Encoded Flipnote refers to RexiMemo's external-encoder origin: a Flipnote created or converted using an external encoder rather than made directly in Flipnote Studio or authored with RexiMemo's Flipnote Editor tool.

• The original material used for an Encoded Flipnote must either be material that you actively created yourself, or the Encoded Flipnote must use third-party material in a meaningfully transformative way.
• Simply converting, porting or reposting somebody else’s YouTube video, artwork, animation, Flipnote, music video or other material to RexiMemo is not allowed merely because it has been put into Flipnote format.
• You must not use encoding as a way to upload stolen artwork, stolen animation, uncredited reuploads or other material you do not have the rights or permission to use.
• You remain responsible for having any rights, licences or permissions required for source material included in an Encoded Flipnote. A transformative edit does not automatically give you rights that applicable law requires you to have.
• RexiMemo staff may remove or restrict an Encoded Flipnote if they reasonably believe it is primarily a reupload, uses stolen material, is not meaningfully transformative where transformation is required, or otherwise violates these Terms.

Flipnote Editor

RexiMemo provides a browser-based Flipnote Editor tool for creating and editing Flipnotes. While Flipnotes made with the Flipnote Editor tool technically go through an encoding process when RexiMemo prepares them as PPM files, RexiMemo processes and records them as a separate Flipnote Editor origin rather than the external Encoder origin described above. The additional rules for externally encoded Flipnotes do not apply merely because preparation of an Editor-made Flipnote involves encoding.

• Content imported into Flipnote Editor, including images, audio, music or material taken from another Flipnote, remains subject to the same ownership, permission and acceptable-use requirements as other User Content. The ability to import or process a file does not give you rights to use it.
• When eligible Music is imported from a local MP3 or WAV file, RexiMemo may keep the original imported audio separately from the PPM for the HD Music web-playback feature, together with timing information needed to keep it synchronised with the Flipnote.
• The PPM itself still contains Flipnote-compatible audio for normal playback, downloading and use in Flipnote Studio. HD Music is a separate web-playback copy and does not replace the audio stored inside the PPM.
• RexiMemo may display a Flipnote Editor origin notice so viewers can tell that the Flipnote was made using the Editor tool.

8. Licence you grant to RexiMemo

By submitting User Content, you grant RexiMemo a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, convert, resize, create previews from, transmit, display, distribute, archive, preserve and moderate that content as reasonably necessary to operate, maintain, improve, promote and protect the Service.

This licence does not transfer ownership of your content to RexiMemo. It continues for as long as reasonably necessary to provide the Service and can continue for limited copies that remain in backups, caches, moderation evidence or other users’ legitimate copies, subject to rights that applicable law gives you.

9. Public content and redistribution

Content published to RexiMemo should be treated as public unless the interface clearly says otherwise. Other users may view, download, screenshot, save, quote, star, favorite or otherwise interact with public material. RexiMemo cannot guarantee that copies made by other users disappear if the original is later removed.

10. Acceptable use

You must not use RexiMemo to:

• break applicable law or encourage serious unlawful conduct;
• upload material you do not have permission to use;
• harass, threaten, stalk, exploit or deliberately target another user;
• publish another person’s private information without appropriate permission;
• post, display, describe, link to or distribute pornography, sexually explicit material, sexual nudity, fetish content, sexual solicitation, or other content primarily intended for sexual arousal;
• post sexual or exploitative material involving minors, non-consensual sexual material, or other unlawful sexual content;
• post or depict realistic or graphic gore, realistic serious bodily injury, or realistic medical distress. As a general rule, gore-related content must not be realistic. Prohibited examples include realistically detailed or exposed bones, muscles, veins, organs, open wounds, dismemberment, severe bodily injury, graphic death, spasms or convulsions, and reenactments or realistic depictions of medical emergencies such as a heart attack. Occasional simple blood, light blood splatters, and clearly cartoonish or stylized injury/impact effects may be allowed when they are plainly non-realistic and do not include those prohibited realistic details. However, repetitively uploading Flipnotes focused on lighter gore, injury or violence is not allowed, including repeated depictions of blood, gunshots, blood splatters, stabbings, injuries, violent attacks or similar material, even where each individual Flipnote might otherwise fall below the graphic-content threshold;
• use profanity, swearing, obscene language or deliberately disguised profanity in usernames, profiles, console names, Flipnote titles or descriptions, Flipnote text or audio, comments, memo comments, channel content or other material submitted to the Service;
• promote, encourage or endorse the use of harder drugs such as heroin, cocaine or similar substances. Depictions or discussion of hard-drug addiction or substance dependency may be allowed when placed in Sensitive 16+ and when they do not promote, encourage or provide instructions for drug use;
• send spam, manipulate stars/follows/views, automate abusive traffic or interfere with rankings or community features;
• upload malware, attack or overload the Service, interfere with other systems, or misuse RexiMemo’s network services;
• evade a suspension, moderation action, upload restriction or other Service restriction.

These rules apply regardless of whether content is drawn, animated, photographed, written, spoken, linked or otherwise submitted through RexiMemo.

Substance-related content

Depictions of cannabis are permitted on RexiMemo. This includes depictions of cannabis use, smoking cannabis, joints, cannabis-only vapes, and cannabis-related paraphernalia. Cannabis-related content does not need to be placed in Sensitive 16+ solely because cannabis is depicted or used. These depictions remain subject to all other rules in these Terms, including the rules concerning unlawful conduct, sexual content, violence, harassment and moderation.

Tobacco and cigarettes may also be depicted. However, content that promotes or encourages tobacco or cannabis use should be placed in Sensitive 16+. Content promoting or encouraging the mixing of tobacco and cannabis should likewise be placed in Sensitive 16+.

Alcohol-related content should be placed in Sensitive 16+.

Hard-drug addiction, dependency or other serious substance-use themes may be depicted in Sensitive 16+ when they are presented as part of a character, story or other contextual depiction. Content that promotes, encourages, glorifies or provides instructions or methods for using harder drugs such as heroin or cocaine remains prohibited regardless of channel.

Sensitive 16+ content

Sensitive 16+ is for material that is allowed on RexiMemo but unsuitable for the normal all-ages discovery areas because it may be distressing or mature. Depending on context and intensity, this can include non-graphic depictions or discussion of self-harm or self-inflicted wounds, suicide-related themes, non-graphic blood or injury, disturbing violence or horror, hard-drug addiction or dependency, alcohol-related content, tobacco-use promotion, promotion of mixing tobacco and cannabis, and other sensitive substance-use themes, as well as other sensitive themes that moderators reasonably determine should be age-restricted.

Sensitive 16+ is not an exception to the rest of these Terms. Content remains prohibited there if it encourages, promotes or provides instructions or methods for suicide or self-harm; promotes, encourages or provides instructions or methods for using harder drugs such as heroin or cocaine; contains pornography or sexually explicit material; contains prohibited realistic or graphic gore, serious bodily injury or realistic medical distress; exploits or sexualizes minors; or otherwise violates these Terms.

If a Flipnote belongs in Sensitive 16+, RexiMemo may move it there, including when reviewing content uploaded before Sensitive 16+ existed. A channel move by itself is a content-classification action and does not necessarily mean the uploader has received a warning, strike or other disciplinary penalty. If the content separately violates these Terms, RexiMemo may also remove it or take account action.

Creators aged 16 or over should place qualifying new content in Sensitive 16+ rather than a general channel. Sensitive 16+ Flipnotes are excluded from the normal Browse feed and access is restricted by the Service's age controls. RexiMemo may change a Flipnote's channel classification when reasonably necessary to apply those controls consistently.

11. Moderation and enforcement

RexiMemo may use automated filters and human moderation. Automated filters can make mistakes and are not guaranteed to catch every violation. A submission not being automatically blocked does not make prohibited content acceptable.

Moderators and administrators may review information reasonably necessary to operate and moderate RexiMemo, including accounts, public and non-public content, linked consoles, sessions, reports, moderation history and relevant diagnostic information. Staff may hide or remove content, lock comments, suspend or terminate accounts, revoke sessions, keep private moderation records and document incidents or actions.

Content containing pornography, sexually explicit material, prohibited realistic/graphic gore or medical distress, or profanity may be removed or restricted. For the gore rule, the general rule of thumb is that realistic depictions are not allowed: this includes exposed or detailed veins, muscles, bones, organs, severe wounds, spasms or convulsions, and reenactments or realistic depictions of medical emergencies such as heart attacks. Occasional simple blood, light blood splatters, and clearly cartoonish or stylized effects may be allowed when they remain plainly non-realistic, but content may still require placement in Sensitive 16+ when its subject or presentation is distressing or mature. Repeatedly uploading Flipnotes focused on blood, gunshots, splatters, stabbings, injuries, violence or similar material may be treated as a violation even if the individual uploads are comparatively mild. Serious or repeated violations may lead to suspension or termination. Accounts reasonably believed to be operated by a child under 13 may also be suspended or terminated.

Substance-related moderation will distinguish depiction from promotion. Cannabis, cannabis smoking, joints, cannabis-only vapes and cannabis-related paraphernalia are permitted, as are ordinary depictions of tobacco or cigarettes. Alcohol-related content and tobacco promotion should be placed in Sensitive 16+. Hard-drug addiction or dependency may be placed in Sensitive 16+ when presented contextually, but promotion, encouragement, glorification or instructional content concerning harder drugs remains prohibited.

Borderline content may also be removed or restricted. If moderators reasonably believe that a Flipnote or other submission is on the brink of violating these Terms, or that its context, intensity, repetition or overall presentation makes it unsuitable for RexiMemo, they may take it down without waiting for it to clearly cross a prohibited-content threshold.

We may take action with or without advance notice where reasonably necessary for safety, security, moderation, legal compliance or operation of the Service.

12. Legacy DSi networking

Using RexiMemo from unmodified Flipnote Studio requires compatibility with Nintendo/Hatena-era networking. Parts of that networking use obsolete security technology and do not provide the same protection as modern web HTTPS. Do not reuse an important password for RexiMemo, and do not send unrelated sensitive information through the DSi connection.

Emulator use

• melonDS is the only emulator permitted to connect to RexiMemo. Other emulators may not be used to access the RexiMemo DSi service.
• You may only sign in to your RexiMemo account from melonDS if that account already has a Primary Console linked to it from a real compatible console.
• From an eligible melonDS session, you may post full, unlocked Flipnotes through RexiMemo's normal Flipnote Studio posting flows. Locked Flipnotes are not accepted from emulator sessions.
• For an emulator-posted Flipnote, RexiMemo changes the posted creator name to your current RexiMemo username and the posted creator FSID to your real Primary Console FSID. The original creator name and original creator FSID are retained as spin-off attribution.
• Mini Flipnote uploads remain prohibited from emulator sessions. Use a real compatible console for memo-style Flipnote comments.
• Flipnotes posted from an emulator may not be uploaded to Sudomemo. Do not save an emulator-posted Flipnote from RexiMemo and repost it there.
• RexiMemo may identify emulator sessions and record whether an individual Flipnote was posted from melonDS so that origin information and the appropriate technical restrictions can be applied.

13. Open-source edition, third-party software and community-driven development

RexiMemo publishes RexiMemo Open Source Edition (OSE) under the GNU Affero General Public License version 3. OSE is a deliberately reduced public edition and is not a source dump of the live production service. Production-only software, infrastructure, security controls, credentials, private operational material and production data remain non-public. Publishing OSE does not grant access to RexiMemo production systems or private code.

14. RexiMemo branding and third-party trademarks

RexiMemo’s name, branding, site design and original material may be protected separately from third-party components. Flipnote Studio is a trademark of Nintendo. Flipnote Hatena is a trademark of Hatena Co., Ltd. RexiMemo is not affiliated with, sponsored by or endorsed by Nintendo or Hatena.

15. Copyright and other rights complaints

If you believe content on RexiMemo infringes your copyright, privacy or other legal rights, email rekunote@gmail.com and identify the material, the right you believe is affected, and enough information for us to investigate. We may remove or restrict material while a complaint is reviewed. Do not knowingly submit false rights complaints.

16. Open Beta, service changes and availability

RexiMemo is currently provided as an Open Beta. Features may be incomplete, experimental, unstable, redesigned, temporarily disabled, reset or removed while the Service is developed.

We may add, change or discontinue features, protocols, channels, moderation tools or client support. We do not guarantee uninterrupted availability, permanent storage, compatibility with every supported system, preservation of every upload, or continued compatibility with Nintendo/Hatena-era software.

You should keep your own copies of material that matters to you.

17. Suspension, termination and deletion

You may stop using RexiMemo at any time. RexiMemo may suspend or terminate access where reasonably necessary for these Terms, safety, security, abuse prevention, legal compliance or operation of the Service.

For account deletion or anonymisation requests, email rekunote@gmail.com. Some information may remain where reasonably necessary for backups, security, moderation evidence, legal obligations, public-content integrity or the rights of other users.

18. Privacy

The RexiMemo Privacy Policy explains what information RexiMemo handles, why it is used, who may receive it, and the choices and rights available to users. It forms part of these Terms.

19. Disclaimers

To the fullest extent permitted by applicable law, RexiMemo is provided “as is” and “as available”, including throughout the Open Beta. We do not promise that the Service will be error-free, uninterrupted, completely secure or suitable for a particular purpose. Legacy DSi protocols have known security limitations.

Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.

20. Limitation of liability

To the fullest extent permitted by law, RexiMemo is not responsible for indirect or consequential loss, loss of data, third-party copies of public User Content, service interruption, legacy protocol limitations or unsupported hardware/software. Any rights or remedies that cannot legally be excluded remain available.

21. Changes to these Terms

We may update these Terms as RexiMemo changes. The current version will be published on this page with an updated effective date. Where a change materially affects users’ rights or use of their content, we will make reasonable efforts to call attention to it. Continued use after the effective date means you accept the updated Terms, except where applicable law requires another form of agreement.

22. General

If one part of these Terms is unenforceable, the rest remains in effect. A failure to enforce a provision once does not waive it. Mandatory laws and consumer protections that apply to you continue to apply.
